All content on the Site — including text, graphics, logos, images, video, audio, software, playbooks, frameworks, and training materials — is owned by or licensed to A Brilliant Tribe and is protected by copyright, trademark, and other intellectual property laws.
You may access and view content for your personal, non-commercial use. You may not reproduce, distribute, publicly display, modify, or create derivative works from any content on the Site without our prior written consent, except as expressly permitted for members of a specific service or program.
"A Brilliant Tribe," the ABT wordmark, and related logos are trademarks of A Brilliant Tribe, Inc. All other trademarks referenced on the Site are the property of their respective owners.
If you submit content to the Site or to us (such as testimonials, feedback, questions in community forums, or applications), you grant A Brilliant Tribe a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, adapt, publish, and display that content in connection with operating and promoting our services. Where our services require payment, prices and billing terms are described at the point of purchase. Unless otherwise stated in a specific program agreement, subscription fees are billed in advance on a recurring basis and non-refundable except where required by law. You are responsible for all charges incurred under your account.
Content on the Site — including coaching materials, playbooks, workshops, and community discussions — is provided for educational and informational purposes only. It does not constitute legal, financial, tax, real estate, or other professional advice, and it is not a substitute for advice from a qualified professional.
Real estate is a competitive and highly variable industry. Any references to results, revenue, growth, or business outcomes reflect the experience of specific individuals and are not a guarantee that you will achieve similar results. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL A BRILLIANT TRIBE, ITS AFFILIATES, OR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SITE OR OUR SERVICES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE OR OUR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify, defend, and hold harmless A Brilliant Tribe, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third-party right.
We may suspend or terminate your access to the Site or any of our services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Site will cease immediately, but the sections of these Terms that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. When we do, we will revise the "Effective date" above and post the updated Terms on this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and A Brilliant Tribe regarding the Site. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
