Scope and Purpose of Services
A Brilliant Tribe™ provides members with ongoing educational resources, coaching, and instructional programs designed to support business foundational development, operational scaling, and industry adaptability. Program focus areas may include, but are not limited to, business systems, administrative support, lead generation, sales strategies, and artificial intelligence tools.
Program Content and Session Format
Sessions may cover a variety of topics, including business operations, prospecting, mindset, and technical skills at the sole discretion of A Brilliant Tribe™, its coaches, or session hosts. A Brilliant Tribe™ reserves the right to modify, add, remove, or reschedule coaching sessions, topics, host personnel, and underlying delivery platforms or technology systems at any time without prior notice.
Membership Model and Access
Membership operates on a recurring basis, granting active members continuous access to scheduled workshops, resources, and associated member benefits. A Brilliant Tribe™ provides access to these tools and live sessions but makes no guarantees regarding, nor assumes responsibility for, individual member attendance or participation.
Data Collection and System Usage
By participating in A Brilliant Tribe™ programs, members acknowledge that interactions within hosted platforms, workshops, and digital tools may be monitored, logged, or recorded to facilitate service delivery, improve platform functionality, and maintain program security. Personal information provided during enrollment and program engagement will be processed in accordance with the A Brilliant Tribe™ general Privacy Policy.
Terms of Service
1. Membership Model, Attendance, and Access
- Discretionary Participation: Utilizing the membership, accessing resources, and attending sessions are entirely at the subscriber's discretion and responsibility. A Brilliant Tribe™ provides access to platforms, workshops, and materials, but assumes no liability for a member's level of engagement or non-usage.
- Dashboard & System Access: Active subscribers receive access to the A Brilliant Tribe™ dashboard, including session replays and materials. Access to all proprietary systems, dashboards, and resources immediately terminates upon membership cancellation or termination.
- Session Format & Duration: Group coaching call durations typically range from 30 to 60 minutes depending on the topic and are designed to be interactive.
- Communications & Onboarding: Instructions for platform access are delivered via email upon registration. A Brilliant Tribe™ may communicate with members via email, SMS/text messages, or social media platforms. Members are automatically included in communication channels and community challenges, though participation is voluntary. Members are solely responsible for ensuring their contact information is accurate and that A Brilliant Tribe™ communications are received.
2. Third-Party Products, Services, and Disclaimers
- Third-Party References: A Brilliant Tribe™ is not responsible or liable for any third-party products, services, recommendations, or upsells presented during group calls, webinars, or events by staff, guest speakers, or other clients. Any purchases or engagements are made strictly at the member's own risk and discretion.
- Educational Templates & Legal Disclaimer: Forms, outlines, agreements, and materials provided by A Brilliant Tribe™ are for illustrative and educational purposes only. They do not constitute legal or professional advice. Members should consult qualified legal or industry professionals prior to executing any agreements based on provided templates.
- Member Representations: Members certify that all documents, details, and information submitted to A Brilliant Tribe™ are true, accurate, and complete. Members agree to comply with all applicable federal, state, and local laws and regulations governing their business operations.
3. Payment Terms, Cancellation, and Refund Policy
- Recurring Billing: Subscriptions auto-renew on a monthly basis on or about the subscriber's initial enrollment date (anniversary date). By subscribing, the member authorizes automated recurring charges to their payment method on file until formal cancellation.
- Cancellation Policy: Members may cancel their subscription by submitting written notice to concierge@abrillianttribe.com. Cancellations require a minimum notice of 7 days prior to the next billing anniversary date to avoid being billed for the subsequent cycle. Notice provided fewer than 7 days prior to the anniversary date will result in cancellation taking effect at the conclusion of the following billing cycle. Access to systems and group sessions continues through the paid billing period.
- No Refund Policy: All payments are strictly non-refundable. A Brilliant Tribe™ does not issue refunds or pro-rated credits under any circumstances, including claims of non-attendance, lack of platform login, or unused resources.
- Rejoining & Price Adjustments: If a membership is paused or canceled, re-enrollment is contingent upon tier availability. Returning members must complete a new registration and agree to the current coaching rates at the time of re-joining. Pricing is subject to change without prior notice.
- Default & Collection Costs: In the event of failed payments or default, A Brilliant Tribe™ reserves the right to suspend access immediately and assign delinquent accounts to a third-party collection agency.
4. Intellectual Property, Confidentiality, and Non-Disparagement
- Proprietary Rights: All names, trademarks, concepts, outlines, documents, and materials provided by A Brilliant Tribe™ remain the exclusive intellectual property of A Brilliant Tribe™.
- Confidentiality: Members agree to keep all coaching materials, trade secrets, system designs, documents, and internal communications shared by A Brilliant Tribe™ or its team strictly confidential and agree not to disclose such information to any third party.
- Non-Disparagement: Members agree not to, directly or indirectly, make any disparaging statements regarding A Brilliant Tribe™, its officers, directors, managers, employees, or agents during the term of the agreement and for a period of two (2) years following termination and or cancellation.
5. Call Recording, Media Release, and Legal Terms
- Call Recording Restrictions: A Brilliant Tribe™ reserves the right to record all coaching sessions, calls, and events for operational and replay purposes. Members are strictly prohibited from recording any session without prior written permission from A Brilliant Tribe™. All session recordings remain confidential.
- Media & Likeness Release: Members grant A Brilliant Tribe™ a non-exclusive, perpetual, royalty-free, worldwide license to record, use, publish, display, and distribute the member's name, image, likeness, voice, biographical information, and property in any media format now known or hereafter developed for advertising, promotional, and educational purposes without compensation or prior approval. Members release A Brilliant Tribe™ from any claims or liabilities arising out of such usage.
- Governing Law & Venue: This agreement shall be governed by and construed in accordance with the laws of the State of California. Any legal proceeding arising under or related to this agreement shall be brought exclusively in the state or federal courts located in Ventura County, California. The prevailing party in any legal action shall be entitled to recover reasonable attorneys' fees, expert witness fees, and court costs.
